Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Florian Trippel, the operator of StockMarket Dashboard (“StockMarket Dashboard,” “we,” “us” or “our”). By creating an account or by accessing or using StockMarket Dashboard, you agree to these Terms. If you do not agree, do not use StockMarket Dashboard.

1. The Service and Your Account

StockMarket Dashboard is a web application for following financial markets: it shows market data, charts, statistics and watchlists on dashboards you arrange yourself (the “Service”). You can use parts of it without an account.

You are responsible for the security of your account and devices and for activity through your account. You may not use another person’s account without permission.

2. License and Acceptable Use

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable license to use the Service for your own purposes. The Service, its software, design, branding and other materials are licensed, not sold. We and our licensors retain all rights not expressly granted. Except where applicable law does not allow a restriction, you may not:

• copy, sell, rent, sublicense, distribute or commercially exploit the Service;
• extract, scrape or redistribute market data from the Service, or access it by automated means other than the Service’s own interface;
• reverse engineer, decompile or attempt to derive the Service’s source code;
• bypass access, plan, usage or security controls;
• interfere with the Service, its infrastructure or another user’s access;
• use the Service to violate law, infringe rights, distribute malicious code or facilitate harmful or fraudulent activity.

3. Your Content

You retain ownership of the dashboards, watchlists, notes, prompts and other content you provide (“Your Content”). You grant us a limited, non-exclusive license to host, store, reproduce, transmit and otherwise process Your Content only as reasonably necessary to operate the Service. You are responsible for Your Content and for having the rights needed to store or transmit it.

4. Market Data and No Investment Advice

Market data, statistics, ratings and signals in the Service come from third-party sources or are derived from them. They may be delayed, incomplete or inaccurate, and they may change or become unavailable without notice. Do not rely on them as the sole basis for a decision.

The Service is provided for information only. Nothing in it is investment, financial, tax or legal advice, a recommendation to buy, sell or hold a security, or an offer of any financial service. We are not a broker, an investment adviser or a financial institution. You alone are responsible for your investment decisions and their consequences. Past performance does not indicate future results.

5. AI Services

AI chats and AI Prompt panels send your requests, with the information the chat or panel includes, to the AI provider you configured, using your own API key. That provider’s terms and privacy policy apply to its processing, and you are responsible for complying with them and for any costs the provider charges.

AI output may be inaccurate, incomplete, outdated or unsuitable for your circumstances. Review it independently before relying on or sharing it. AI output is not investment, financial, tax or legal advice.

6. Free Plan, Trial and Pro Subscription

StockMarket Dashboard offers a Free plan, a one-time 7-day Pro trial per account, and a Pro subscription billed monthly or yearly. The features of each plan are described in the Service and on our website.

The price, billing period, taxes and renewal terms shown at checkout govern your purchase. Prices may differ by country, currency and applicable tax. A subscription renews automatically until you cancel it. Cancel it through Paddle, using the link in your receipt; deleting your account does not cancel a subscription.

A refund, payment reversal, expiration or cancellation may end the related Pro access. Refunds are described in our Refund Policy. Nothing in these Terms limits refund, withdrawal or cancellation rights that cannot legally be waived.

7. Third-Party Services

The Service works with services of third parties, such as Google, Apple and Microsoft for sign-in, AI providers, market-data providers, Paddle for payments and websites you open through links. These services are independent, may change or become unavailable, and are governed by their own terms. We are not responsible for their services, content, availability or acts.

For purchases, Paddle is the merchant of record and authorized reseller. Paddle’s Buyer Terms apply to the purchase in addition to these Terms.

8. Privacy

Our Privacy Policy explains how the Service processes personal data and which rights you have.

9. Availability and Changes to the Service

We may update, modify, suspend or discontinue features to maintain or improve the Service, to meet security or legal requirements, or because a third-party service changes. Availability and features may differ by device, country and plan. Where applicable law requires it, we will give notice of, or remedies for, a material adverse change.

10. Changes to These Terms

We may update these Terms to reflect changes to the Service, our business, third-party requirements or applicable law. We will inform you of a change that materially affects your rights or obligations before it takes effect. Corrections and clarifications that do not affect your rights may take effect when posted. The version and effective date identify the Terms that apply.

11. Suspension and Termination

You may stop using the Service at any time and delete your account in the Service, subject to the records we must keep, as our Privacy Policy describes.

We may suspend or end access when reasonably necessary to protect the Service, its users or third parties; to investigate fraud, payment disputes, security incidents or unlawful activity; to enforce these Terms; or to comply with law. Where appropriate, we will give notice and an opportunity to resolve the issue. Provisions that by their nature should survive termination remain in effect.

12. Disclaimer of Warranties

To the maximum extent permitted by applicable law, StockMarket Dashboard is provided “as is” and “as available.” We disclaim all express, implied and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy, and that the Service will be uninterrupted, secure or error-free.

Some jurisdictions do not allow certain warranty disclaimers. In those jurisdictions, the disclaimers apply only to the extent permitted by law. These Terms do not exclude any warranty or consumer right that cannot legally be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we and our licensors and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, trading or investment losses, revenue, goodwill or data, arising out of or related to the Service or these Terms.

To the maximum extent permitted by applicable law, our total liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount you paid for the Service during the twelve months before the event giving rise to the claim or (b) EUR 100.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability for intent and gross negligence, for injury to life, body or health, under mandatory product-liability law, or for the breach of an essential contractual obligation, in which case liability is limited to the foreseeable damage typical for the contract.

14. Governing Law and Consumer Rights

German law governs these Terms, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of the mandatory protection of the law of the country where you live. Any legally required place of jurisdiction remains unaffected.

15. General Terms

These Terms, together with the policies and purchase terms they reference, are the entire agreement between you and us regarding the Service. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, sale or transfer of the Service, subject to applicable law.
